Happy Independence Day which was fought for by the Heroes, of course they have fought with the hope that we will be free from colonialism and poverty, both colonialism from other nations and from others so that the economy will be better and prosperous for all Indonesian people.
Freedom is when we can take advantage of what we have and benefit other people, so what if this turns into suffering for what we already have and when we still have to struggle amidst an uncertainty of authority which can easily be turned into a performance attractions by irresponsible elements of the nation itself.
That now, after 79 years of Indonesia's Independence, we know that there are still many cases of land disputes that occur due to lack of good governance in the land sector, and one of them is that with the expansion of a region, data on land objects is often whitewashed, this is very has the potential to create conflict vulnerabilities or open risk gaps when updating land data in areas where expansion occurs.
For example, there is the case of a land dispute in the Tangsel area which was a division of Tangerang Regency in 2009, where due to the whitening of land data in that area there was the suffering of a mother who is also a retired civil servant who still had to fight to defend her land rights for dozens of years. years until now due to the actions of irresponsible individuals.
Mrs. Siti is the owner of land which she obtained through a buying and selling process with an indigenous seller who is also a community figure in the area around 1982, but around 2016 Mrs. Siti was reported to the police by someone who claimed to be has owned the land since 2009 and based on this report, Ms. Siti was named a suspect, and in 2019, Ms. Siti was also sued civilly at the District Court, where based on the report to the police, Ms. Siti asked for legal assistance from LBH JAKARTA to help provide assistance. for him who is blind to the legal process.
And in 2021, Mrs. Siti was again sued civilly for the second (second) time for alleged unlawful acts, which in the process of the lawsuit in 2021, at the end of 2023, there was a Supreme Court decision which stated that the plaintiff had the rights to the land object. dispute.
How is it possible that a mother who has bought land since 1982 or around 42 years ago and where a house has been built since 2007 can be defeated by someone who claims to have bought the land in 2009 using land data/bases? the-mother?
Mrs. Siti requested mediation in 2011 from the Tangerang Regency BPN Office, where it was only discovered that Mrs. Siti's PBB data had been altered/changed unilaterally and arbitrarily by irresponsible individuals, and also during the mediation, Village officials apologized directly for the mistake of his subordinates who had changed PBB data and at the same time promised to restore the data to Mrs. Siti's name again, but this was never implemented and there was never any party who took the slightest responsibility for the incident of changing the land base data. the-mother.
Regarding the civil lawsuit in 2019, Mrs. Siti was accompanied by a legal advisor recommended by LBH JAKARTA and the Panel of Judges decided that the civil case was dismissed.
Feeling dissatisfied, again in 2021 the land officials who were in fact officials in the area filed a civil lawsuit for the second (2) time at the District Court, where in 2023 there was a Supreme Court decision rejecting the appeal from Mrs. Siti and the Defendant. /other indigenous communities at the location of the disputed land.
In this case, where can the State be present in providing Social Justice for its people who are taxpayers? And where will independence take us, by us or by whom?
What is this State and how long will it be true? if the law has been made into an attraction and a game tool and not based on the law, but only always for those who postulate it using the basis of authority and arbitrariness.
Irresponsible individuals can easily criminalize someone, openly falsify facts without the original and provide information for the purposes of their orders, and of course it is time for society to be aware of the law, that currently many people have been convicted but it is not certain guilty, that this is not in accordance with guaranteeing rights to the people in accordance with the constitution.
Hopefully this short narrative can be an examination of the atmosphere of our independence, how many years and how long will it take for us to be truly independent? Will freedom come in the future when we can no longer speak the truth?
